What Is A Process Server?
A process server delivers legal documents to individuals involved in a court proceeding.
In California, the server must be 18 years old and not a party to the case. (i.e.,. Plaintiff, Defendant, Petitioner, or Respondent) and the server must deliver the documents in person or by another legal method allowable under the laws of the state, county or local government.
California process servers must be registered with the county clerkâs office and, once registered, may serve legal documents anywhere in the state.
Do I Need A Process Server?
Hiring a Legal Process Server is an important step in proceeding with a lawsuit. In some states, someone who performs service of process is required by law to be registered or licensed, so if you are in one of these states, the answer is "Yes!".
Even if a process server does not need to be licensed in the state where you need service, you should keep in mind that a process server is someone who is experienced in serving legal documents efficiently.
More importantly, professional process servers are knowledgeable of the legislation surrounding service of process in their state or county. There are several requirements and constraints associated with serving legal documents that vary from state to state, or county to county.
If the service is not performed in accordance with the law, this can hinder your case from going forward or result in the dismissal of your case.
What Does A Process Server Do?
A process server delivers legal documents to a defendant or an individual involved in a lawsuit. The process server must serve the documents in accordance with the laws in the jurisdiction of service or by the laws of the forwarding jurisdiction.
This service is performed by handing the documents to the individual personally or by effecting substitute service upon someone in the same household or business. Documents are delivered to someone of proper age, which varies state to state.
Once the documents are served, the process server is required to provide proof that the papers were served. This is done through a document call an Affidavit of Service, also called a Proof of Service, which may be notarized and given to the party who requested service. Process servers may also file your legal documents with the courts, handle document retrieval and may offer various types of services.
Process Server Instructions
A letter of instructions must accompany all process or notices brought to the Process Server for service.
This letter of instruction is required by law and must identify the name of the individual/judgement debtor and the address for service. A detailed description of any property sought and the relevant code sections. The letter of instruction must be signed and dated by the plaintiff and or attorney of record. (CCP 262)
